The Environmental Control Hearing Board (ECHB) was created in 1985 by a Special Act of the Legislature in Indian River County. The Board was formed because local enforcement could not be done without involvement of the circuit court, which is a lengthy and expensive process, or relied on multiple governmental agencies. Through the ECHB, counties have local control of state laws that protect the environment and public health. Local control allows for resolution focused on compliance, which is driven by Indian River County residents appointed to the Board.
The purpose of the ECHB is to protect the environment and public health. The Board functions as an extension of Code Enforcement for solid waste, dumping, rodent and hazardous waste discharge complaints giving the county local control over enforcement of state laws. These complaint situations typically fall to state agencies that do not have timely mechanisms for resolution or local presence and knowledge. The existence of the Board allows for timely enforcement of sewage and hazardous waste discharges which may impact the condition of the Indian River Lagoon, our waterways and ocean. Prompt abatement of local sanitary nuisances and public health issues is an advantage of the ECHB with compliance the main goal.
